Woman that found finger in Wendy's chili is not suing. Would you?

(AP) A woman who claimed she scooped up a human finger in her chili at a Wendy's restaurant has decided not to sue the fast-food chain.

Anna Ayala dropped her claim because it "has caused her great emotional distress and continues to be difficult emotionally," said her attorney, Jeffrey Janoff.

Ayala, 39, claimed she found the 1 1/2-inch long fingertip on March 22 while dining at a Wendy's restaurant in San Jose. She later filed a claim with the franchise owner, Fresno-based JEM Management Corp., which her attorney had said was the first step before filing a lawsuit.

Court records show Ayala has a history of making legal claims against corporations, including a former employer, General Motors and a fast-food restaurant. She acknowledged receiving a settlement for medical costs a year ago after claiming that her daughter was sickened after eating at a Las Vegas restaurant.

From what i heard This woman has filed many lawsuits.

Wendy's offered 50,000 reward for information on how the finger go there.
methinks Wendy's pressure was backing her into a corner and exposing a lie.
If it were the truth she would've pushed forward.

So if it happened to me i would likely file suit and follow through but if it happened to me it wouldn't be a lie.

Ironicially enough, I ate Wendy's for lunch today, but stayed clear of the Chili.

I think a lot of people take a problem and attempt to turn it into a lawsuit, when most the time it's ridiculous. It's an urgent issue in health care right now.

In this case, however, I think she should file. C'mon, I mean a HUMAN FINGER! That's disgusting. Unless of course you're Hannibal.

Yeah, I find it hard to believe she has decided not to sue because of "emotional distress". If there was really a finger in there and she could prove it, she'd be sticking Wendys for enough green to set her up for the next few decades, as I would be!!

I worked for Wendy's in my youth...know everything there is to know about the chili and how it is made.

I don't buy it...never did.

Yeah i guess all people react differently but if it were me "emotional distress" wouldn't cause me to withdrawal, actually i think i'd tack on a couple more million for additional "emotional distress".

I wonder if she feared someone would call in and explain the true origin of the finger for the $50,000.

lol, I know how you feel. I worked at a MacDonalds when I was 17. We used to find a few buggies in the french fryers when we were cleaning them out. And the grill that they cooked the burgers on was always disgusting.

Well the grills should be screened(at least) once a day...

Some teens who worked at a fast food restaurant here in town got fired for using the LARGE hamburger patties as skates....and then cooking them and selling them to unsuspecting customers!

I worked at a pretty upscale steakhouse in Clearwater Fla. for awhile in the early 80s.

I know what a mis-steak is.

If I worked at Wendy's and could eat that chili for free, I'd eat it every day That chili is sooooooooooo good especially on a cold day to warm you up, mmmmm

I work at Wendy's up in Canada and find that quite astonishing! Knowing how Chili is made how in the heck did the finger get in there!!! First you have Chili meat off the Grill you then freeze it for 5 days top. You then boil it again and chop it up into sizes no more then a dime. The other Ingredients are Tomato sauce in a Can, Kidney beans and some other beans in a Can, then you put in a mix of Veggies that is in a Frozen bag and a thing of special Seasonings, and water and you are done. How did it get in there in the first place!!!!! How could you not see it when you pour it into a Cup to serve!
