Slippery Slope-Md. Court: Downloading Child Porn Does Not Violate Law
I understand the ruling...BUT....the man is STILL a PERVERT for downloading kiddie porn...I don't care whether he kept it to himself or not! He should be arrested for downloading the kiddie porn!!! There is absolutely no valid reason to view kiddie porn! Maryland better work on their kiddie porn law!

Man Argues 'Depict' Means 'Create'

WASHINGTON -- A court ruling in Maryland is helping define a state law that deals with computers and child pornography.

The law makes it a crime to "use a computer to depict or describe a minor engaging in an obscene act." The court of appeals ruled this week that merely downloading child pornography from the Internet does not violate that law.

A man in St. Mary's County successfully argued that the word "depict" in the law means "create."

He said he didn't create the image, he just downloaded it. And he kept it to himself -- he didn't distribute it.

This is what my Collegiate Edition Merriam-Webster Dictionary says:

Nowhere is the word "create" in that definition.

I don't have issue with that tgg....I'm wondering why he wasn't charged with downloading the child porn! Maybe that's the next thing he'll be charged with. They should also trace back to where he got it from and go from there...maybe they can arrest a whole bunch of pedophiles!

He was arrested for having accessed a paedophile website (traced by his credit card) yet his defence was that he was conducting research on the ease with which such material could be accessed online

Needless to say, there is no PROOF that he is a perv ... at least enough to secure a criminal conviction - BUT I wonder how many non celebs without other celebs acting as character witnesses, would be cleared of this ?

I understand that many TSG members being of that generation, may believe that he couldn't possibly be guilty - but it certainly raised a few eyebrows here at the time.

Hi RSM: I remember that well! We had a thread on it in CivDeb. I'm one of the ones...even though from his generation....that believes he was up to no good! By the way....has his purported book that he needed to "research" kiddie porn for come out yet? Celebrity definitely helps in cases like this....look at MJ...another one I still think was up to no good...and you see how some members of his jury are now writing books saying they believe he was guilty.

I actually emailed his agents to ask when this 'treatise' would be published. Their response was that my enquiry constituted at best a gross impertinence, and at worst was potentially libellous

Child porn is illegal-no two ways about it. I'm just wondering why the meaning of the word "depict" is relevant-he was viewing, sending, storing, or maybe even creating child porn. It's friggin' CHILD PORN! WHICH IS ILLEGAL! Why why why why WHY was this moron let go of?

While I suspect Pete was up to no good, I do believe he was the first casualty of our new Patriot act (our gov. informed on him) and I don't believe his actions were terrorist related (any more than Chong's bongs were).

tgg: Yeah...so the guy won on the "depict" vs "create" opinion....he must be so proud of himself........so he didn't break the law that makes it a crime to "use a computer to depict or describe a minor engaging in an obscene act"...now arrest him for "downloading and viewing it"...we're in total agreement!

Angel,

Yes - I actually saw that link, it was the first hit when I googled this comedian. I firmly believe he was looking for such material also. What people who give him the benefit of doubt are doing, is thinking 'why would anyione in their right be looking for child porn ?'

Indeed a valid question - why would they. Even to this day I do not like my older cousins with children inviting me to play with their infant children. I know I wouldn't do such a thing - BUT how can any parent be sure of another adult, no matter how trusted they are ? It seems to be the one everyone trusts who ends up being guilty

Sadly we here have no death penalty for such people. Fortunately when they get sent to prison - the prison officers accidentally tell the other inmates what 'that man' is in for.

The rest of his sentence is best described as 'uncomfortable.' Though they often do not survive ... slipping in the showers, falling down stairs, etc

Luckily its not only The Lord that 'works in mysterious ways.'

Depict means create----You depict a scene on canvas, or your story depicts life on the Plains. Seriously, although many people who access kiddie porn sites are perverts, some are just surfing and have a bizzare interest in seeing what is all about. That doesn't necessairly translate into an attempt to molest a child. The government needs to do a better job of attacking the "depicters" of kiddie porn.
