LOL Oh please do tell! Hey, do you ever watch The Amazing Race? Last night, they were in Costa Rica and there's this one team that just... wow. Anyway, they were asking a local for directions and she leans out the window, "Down this road? Righto or Lefto?" I about fell out. What is ultimately going to be decided is whether a state has to prove a detriment to society in order to justfy a law against abortion (or any other restriction of personal freedom or privacy for that matter). As of now, a non-viable fetus does not have that protection under the constitution. The mother has privacy rights protections because the non-viable fetus is not considered a "person" in the 14th ammendment sense of the word.

My gut feeling about Alito is that he has his legal and philosophical feet firmly planted in the ground here. I will aver that he is an "Aristotelian" not a "Platonist". Meaning he wants empirical evidence to support a state mandated curbs on rights of privacy or expression. He does not have some ideal moral vision in his head nor will he allow others to impose theirs at the expense of privacy or freedom of expression merely because it offends their sense of moral and religious harmony.

The empirical burden will be on the state to show harm to its interests, not the mother.

Any other interpretation of the constitution allows for the gutting of the 14th ammendment by legislative fiat.
