New curbs placed on sex offenders

Day care centers, libraries among off-limits sites, county decides

Registered sex offenders in unincorporated Sacramento County are no longer allowed to visit libraries, day care centers, video arcades, skate parks, public swimming pools, county parks, youth sports facilities and bus stops.

In a 5-0 vote Tuesday, the county Board of Supervisors expanded state law that prohibits them from being on or around school grounds without specific permission by adding eight additional prohibitions.

Passed as emergency legislation, the ordinance took effect immediately Tuesday.
No sooner had the supervisors acted than the county Public Defender's Office said the new ordinance is unconstitutional -- and likely will be challenged by the office.

"This is just reactionary and overly broad, " said Steve Lewis, the county's chief assistant public defender.

The county ordinance mimics measures recently adopted in Elk Grove and Folsom.

All three ordinances were sparked by news that convicted child molester Timothy Lee Boggs is expected to move back to Sacramento County after being released from a state program for sexually violent predators.

Before the vote, Supervisor Don Nottoli added libraries to a list of places in the county where it would be illegal for registered sex offenders to go "on or within" 300 feet.

Supervisor Susan Peters said that in introducing the ordinance, her interest was in protecting children.

But Lewis said the ordinance is so broad that it doesn't focus on those convicted of molesting or assaulting children.

Rather, it covers all registered sex offenders, including those who aren't likely to pose a threat to children.

And, he said, some of those offenses date as far back as 1944.

Under the ordinance, registered offenders cited face fines up to $1,000.

The new law would not apply to offenders making a single trip past youth centers, state-approved offender residences or sex offenders who also are parents and are with their children.

The Sheriff's Department estimates 1,800 registered sex offenders live in unincorporated Sacramento County, Elk Grove, Rancho Cordova and Citrus Heights.

Elk Grove and Folsom passed local ordinances when it was reported that Boggs -- arrested three times in the '70s and '80s for molesting young boys -- would soon be moved to a trailer outside either Rio Cosumnes Correction Center or the Folsom prison complex.

Boggs, 52, has been a patient in the state's sexually violent predator program at Atascadero State Hospital for eight years.

A statewide measure on the November ballot would prevent sex offenders from living within 2,000 feet of a school or park.

Really? Not to a library or a bus stop? I assume that would include light rail as well. So are we really comfortable prohibiting sex offenders from taking public transportation? Look, I'm not a real big fan of sex offenders or anything, but this is absurd. I know that the idea is to keep them away from places where children may be loitering without parental supervision. It makes sense to me that they don't have a need to be on school or day care grounds unless they're picking up their own child. And ok, maybe you throw in video arcades and skate parks and whatnot as being pretty much the exclusive domain of kids. But to say they can't avail themselves of public services like the library or regional transit ... it's simply unreasonable IMO.

it's an interesting point, and perhaps indicative of a larger failing in our society....i've posted elsewhere than pedofiles are about on a par with mosquitos to me...and i can't say if what appears to be the dramatic increase in the adult sexual abuse of kids is a function of the real world, or of media exposure to the issue....BUT it seems that if our "goal" is to reintegrate them back into society, and we let em live on a street with kids, then it's pretty inane to keep 'em from entering a library.....

what's missing here to some degree, at least, is parental supervision and community education...fine, it's downright scary to have a registered sex offender two doors down, but predators will continue to exist, regardless of how restrictive the law is.....but it IS the communities responsibility to protect its children, and this means looking out for each other....being aware of your surroundings....wild animals have figured this out....a herd of grazers will not all drink at once....some drink, while other remain aware of what's happening around them....

when this interactive connection is broken by fear or distraction, predators will take advantage.

Precisely. If the goal is not to integrate them, or to give them back any sort of personal freedom, then keep them locked up or on permanent house arrest. But if they're going to be able to live on the same street as a kid, and go to the grocery store, and to the movies, and to the pizza parlor (hee hee - "pizza parlor"!), then it doesn't make sense that they can't ride public transportation.

Offender seeking to live in Natomas

A sexually violent predator whose court-ordered release has been delayed for 13 months is asking to be allowed to live in a trailer on 60 vacant acres of land in the Natomas area, his attorney and the landowner said Thursday.

But word of the proposal for housing convicted child molester Timothy Lee Boggs near Interstate 5 and Del Paso Road sparked immediate concern in the adjacent neighborhoods, where parents of young children and school officials said they would adamantly oppose it.

"I can't imagine anyone's going to be happy about it," said Hiren Patel as he stood in the doorway of his Hawkcrest Circle home a half-mile from where Boggs, 52, could be placed.

Patel, who has 6-month-old twin girls, said he understands the need to find housing for such offenders, but that less densely populated areas are much more suitable than a site near his gated Westlake community. "Do you really want to put a sex offender in a residential area full of children?" asked Patel, an attorney.

The proposal was floated Thursday in an interview and court documents by Boggs' attorney, Ken Rosenfeld, and Sacramento bounty hunter Leonard Padilla, who owns the vacant land and has offered to hire Boggs as a security guard for the parcel.

County and state officials would have to approve the location. Kirsten McIntyre, a spokeswoman for the state Department of Mental Health, said Padilla's offer is "so new we haven't had a chance to walk the site yet."

McIntyre added that the department is considering four other possible sites to place Boggs, whose offenses occurred decades ago in the Sacramento area.

Boggs' crimes include his 1984 arrest for allegedly molesting a 9-year-old boy on a boat during a fishing trip. Boggs was sentenced to 180 days in jail and five years of probation in that case.

In 1988, while still on probation, he molested another 9-year-old Sacramento boy whose family he had befriended. He received a 13-year sentence and served seven years. With two months left on Boggs' parole, an officer found two empty beer cans in his trash -- a parole violation that returned him to prison. While there, he was classified as a sexually violent predator and sent to Atascadero State Hospital for treatment.


Boggs has been incarcerated at Atascadero as a "sexually violent predator" for eight years and completed the intensive, four-phase inpatient therapy program.

In May 2005, a court found that he was eligible to be released back to his home county of Sacramento to complete the fifth and final phase of treatment -- which could take about a year. During that time, Boggs would have to wear a satellite tracking device.

However, Boggs has remained in custody for 13 months because the state Department of Mental Health has been unable to find a place willing to accept him. Previous plans to house Boggs on the grounds of Folsom State Prison or the Sacramento County satellite jail south of Elk Grove sparked immediate opposition. That's where he belongs.

Elected officials in Folsom, in Elk Grove and on the Sacramento County Board of Supervisors each subsequently voted to restrict where such sex offenders may spend time.

But Rosenfeld said such measures have no real legal weight. "The court issued an order," he said. "Whether or not the community agrees with it doesn't matter."

A release hearing for Boggs is set for July 14. Rosenfeld has asked the court to release him without conditions, saying his treatment has made him safe. Rosenfeld said he came forward with Padilla's offer out of concern the state or county would never come up with a location. Yeah right! Move him in next to the Rosenfeld family.

"We're not talking about Hannibal Lecter," Rosenfeld said, referring to the psychopathic killer in the movie "Silence of the Lambs." "We're not talking about releasing a wild animal into the community." That's his opinion.

Changing Direction in Iraq

I believe the open-ended commitment in Iraq is no longer sustainable. The war has gone on for 39 months with no end in sight. More than 2,500 brave men and women of America's fighting forces have been killed. Another 18,500 have been wounded. And as many as 50,000 Iraqis have been killed.

This past month, Senate Democrats called for a change in direction by introducing an amendment that would begin the downsizing of American troops and require the President to submit a plan by the end of the year with a timetable for withdrawal.

Unfortunately, that measure was defeated. But we have now learned that General Casey, the American commander in Iraq, has drafted a plan that projects sharp reductions in the United States military presence there by the end of 2007, with the first cuts coming this September.

It was ironic that General Casey’s apparent plan to withdraw U.S. forces was disclosed only days after the White House and the Republican leadership in Congress blasted a proposal that had called for such a move.

Clearly, it is time to stop the political posturing and change direction in Iraq. We need to listen to General Casey and Iraqi leaders like National Security Advisor Mowaffak al-Rubaie who are hoping to see a redeployment of our troops in Iraq.

It is the right thing to do for the overwhelming majority of the American people who have stated clearly their desire for a change of course in Iraq. And I believe it is the right thing to do for the Iraqi people.

Better Budgeting for America's Future

This month, an effort to repeal the Estate Tax in its entirety failed in the Senate. At a time when our nation’s most critical domestic priorities are not being given adequate support, I believe that cutting a tax that affects such a small number of very wealthy Americans is the wrong priority for America.
This year, our deficit is projected to be $300 billion. The national debt is upwards over $8.4 trillion dollars—that’s a new record. And by 2011, that debt will be nearly $12 trillion dollars.

The President’s tax cuts have already cost more than $1 trillion, and will amount to more than $3 trillion in losses over the next decade. Cutting the estate tax now would have cost another $1 trillion in federal revenue over the next fifteen years.

This is the first time in history that such extensive tax cuts have been enacted or continued during a time of war. When you combine the cost of the tax cuts, and the cost of the war at $370 billion to date—the inevitable result is that all other domestic programs are frozen. That means schools, food assistance for seniors, the COPS program, national parks, highways, and other vital programs like job training are cut.

So, I believe we need to change course immediately--we need to get our nation's fiscal policies back on track by stopping the tax cuts, reforming entitlement programs, and focusing on our domestic priorities like education, health care, transportation, and public safety.

Combating Climate Change

The danger signals of global warming are all around us -- from the melting snows of Mt. Kilimanjaro to the increased ferocity of hurricanes in the Gulf.

Global warming cannot be stopped. But it can be controlled -- if action is taken soon to slow, to stop, and to reduce our emissions of greenhouse gases.

So what can we do? We can create a national framework for businesses to reduce greenhouse gases. I am working on a mandatory cap and trade system which would involve agriculture and reward farmers and for adopting practices that are more environmentally sound.

We can also raise the fuel efficiency of our vehicles, encourage alternative energy sources like ethanol, and promote energy efficiency. And the time has come for the United States to make addressing global warming a number one priority and join the European Union and other nations in reducing emissions. There is no one solution which can achieve this reduction. Rather, there needs to be a commitment on several fronts -- from individuals, from business, and from State and federal governments to address this challenge. If nothing is done and the Earth warms five degrees in the next 50 years, the face of our planet will be changed forever.

Raising Fuel Economy Standards for America's Cars and SUVs

Drivers are paying as much as $60 or more for a tank of gas at the pump in many parts of the country, and there is no end in sight. The time has come for a fresh approach and real leadership. We need new technologies that will promote higher fuel economy, less reliance on foreign oil and fossil fuels, and a major reduction in greenhouse gases.

I believe one of the most important steps we can take to address our energy needs is to raise fuel economy standards. That's why I recently joined with a bipartisan coalition in the Senate to introduce the "Ten in Ten Fuel Economy Act." This legislation would raise the average fuel economy standards for all passenger cars, light trucks, and SUVs from 25 miles per gallon (mpg) to 35 mpg by model year 2017.

The bill would ensure that the standards are there to prompt the auto industry to build a cleaner fleet. If passed, it would not only save 2.5 million barrels of oil per day by 2025 – and save consumers as much as $2,500 over the life of the vehicle – but it would also prevent 420 million metric tons of carbon dioxide from entering the atmosphere, that's the equivalent of taking 90 million cars (or 75 million cars and light trucks) off the road in one year.

When it comes to the fuel economy of America’s cars and trucks, we simply must do better – and this bill puts us on that path.

Ending the President Roadblock on Stem Cell Research

The potential for stem cell research was in the news again this month, when scientists at Johns Hopkins announced that they used embryonic stem cells to regenerate damaged nerves in paralyzed rats.

Just imagine what this discovery could one day mean for patients with spinal cord injuries, multiple sclerosis or ALS! Our researchers, however, face a major roadblock imposed by the President in August of 2001, when he limited Federal funding to 22 lines of stem cells. All of these available lines are now contaminated with mouse feeder cells, so virtually there is no Federal ongoing research.

Thirteen months ago, the House approved a bipartisan bill by Representatives Michael Castle (R-Del..) and Diana DeGette (D-Colo.), a bill that would remove this roadblock -- the bill would make it possible to use embryos that are rejected in IVF clinics; that is, in vitro fertilization clinics. Tens of thousands, if not millions, of these embryos are rejected and they are destroyed. Those embryos could be taken to form new stem cell lines under this bill.

The votes are there to pass this bill today, but the President has vowed a veto, and the Republican leadership refuses to bring it to the floor. It is time the Senate place the health of Americans ahead of the views of a limited number of people whose views are apart from the mainstream of America.

We owe it to the 110 million Americans suffering daily from debilitating and catastrophic disease to pass the Castle-DeGette legislation. Every day that we wait, more people develop diseases that could one day be cured. Every day we wait, other nations move further ahead.

Father kills 4 kids, then himself

He apparently shot the children as they slept after a dispute with his wife.

Gustine Police Chief Don Hutchins, at a news conference Tuesday, provides details of an apparent murder-sucide that left four children, ages 5 to 12, and their father dead after the man and his wife had a quarrel.

GUSTINE -- A man killed his four sleeping children with a hunting rifle early Tuesday morning before turning the weapon on himself, police said.
Police identified the dead as Trevor Branscum, 37, Aubrie Branscum, 12, Jacob Branscum, 10, and 5-year-old twins Taylor and Alyssa Branscum.

Trevor Branscum had just returned home with his wife, Amanda Trimble, after the two had argued at a nearby market, police said.

Trimble, 33, left with a friend and didn't return for about an hour. When she came home, she entered the house, saw her husband lying dead, ran out and collapsed on the street.

Her friend then called police at 1:30 a.m.

When officers entered the four-bedroom, tri-level house on the west side of town, they found Trevor Branscum lying in a pool of blood on top of the suspected murder weapon.
Police said his body was found near a stairway next to the kitchen/nook. Twins Alyssa and Taylor were found nearby in the family room. Jacob was found in the bedroom next to the family room. Aubrie was found on the top level in the master bedroom.

All the children apparently died from gunshots to the head, according to Mayor Jim Bonta. Police Chief Don Hutchins said two of the children were shot at "very close range."

Police told the mayor that Branscum had to reload the rifle before each shot.

With a population of about 5,200, Gustine is located about 90 miles northwest of Fresno.

A family member, who asked not to be identified, said Tuesday night that Trimble is staying with her parents near Sacramento as she tries to cope with the immense loss.

She described Trimble as a "wonderful mother" and homemaker who had recently begun working a night shift after the children were put to bed.

"Four little lives gone, it's such a shock," she said. "(Trevor Branscum) seemed like such a wonderful father. He adored his children, but I think he did this to punish Amanda."

Police said the evidence points to a murder-suicide, but they will continue investigating. They said Trimble is not a suspect. Police interviewed her briefly before she "went into shock."

One of the last people believed to have seen Branscum alive was the owner of Borrelli's Market. A little over an hour before the bodies were discovered, Trimble entered the store to buy some things and was followed inside by Branscum.

The couple was seen arguing there just after midnight, police said.

The store owner, whom police have not identified, called to request an escort to his home after he told police he was concerned after witnessing Branscum and Trimble argue.

Governor: My vote for Prop. 187 was 'wrong'

In his clearest statement to date, Gov. Arnold Schwarzenegger renounced his one-time support for the anti-illegal immigrant Proposition 187 by calling his 1994 vote "wrong," according to an interview published Tuesday by the Spanish-language newspaper La Opinion.

In the same interview, the Republican governor downplayed his past praise of the Minutemen, the brigade of private citizens that has tried to stop illegal immigrants from crossing the U.S.-Mexico border.

Schwarzenegger said during his successful 2003 recall campaign that he had voted in 1994 for Proposition 187, which was intended to prevent illegal immigrants from obtaining public services, including education and health care. The initiative passed overwhelmingly but was overturned by courts.

But in his Monday interview with La Opinion, Schwarzenegger said, "I think, looking back, it was the wrong decision."

The governor also reiterated that he had proposed $23 million for counties to spend on health care for undocumented children, a move that contradicted the spirit of Proposition 187. But Schwarzenegger and legislative Democrats removed the funding in late June as part of a budget compromise with Republicans.

Schwarzenegger last year told the Los Angeles conservative talk radio duo John and Ken that he thought the Minutemen had done "a terrific job." But on Monday, he renounced that belief as well.

"That was probably a mistake, some of the things that I said, that they're doing a great job and all of those things," Schwarzenegger said to La Opinion.


Though the Republican governor has the backing of 85 percent of his own party's voters according to a Field Poll released this week, his leftward shift on immigration prompted criticism Tuesday from conservative Republicans at a town hall meeting outside San Diego, according to the Associated Press.

"I voted for you. And right now I don't see much difference between you and Phil Angelides," said Sally Plata, a 66-year-old retiree from El Cajon and a Minutemen civilian patrol member, the AP reported.

Angelides, the Democratic gubernatorial candidate, accused Schwarzenegger of simply playing politics.

"For nearly 12 years, Arnold Schwarzenegger stood squarely behind Proposition 187 on this divisive measure that pitted Californian against Californian," Angelides said in a statement. "Now, the same governor who praises the Minutemen is attempting yet another election year conversion."

San Jose State political science professor Larry Gerston said Schwarzenegger is figuring out how to position himself enough in the middle without upsetting too many conservative Republicans.

The Republican governor now has invited Assembly Speaker Fabian Núñez and Los Angeles Mayor Antonio Villaraigosa, the state's two most powerful Democrats and Latinos, to join him on the trade mission in November, according to Thompson. So transparent!

Offender to be set free today
State, unable to find housing, will drop and track him in Sacramento County.

Urgent, last-minute efforts to find housing for convicted child molester Timothy Lee Boggs have failed, meaning he will be released from Atascadero State Hospital this morning, driven to Sacramento County and dropped off wherever he asks.

Boggs, a "sexually violent predator" the state considers one of California's most dangerous sex offenders, will be monitored by a satellite tracking device he must wear constantly and will be kept under surveillance by a private security firm hired by the state to follow him, a state Department of Mental Health Services official said Thursday.

He also must register his address -- wherever it ends up being -- with local law enforcement within five days, which will have it posted on California's registry of sex offenders at www.meganslaw.ca.gov.


However, Boggs' return to Sacramento County comes with few of the previous safeguards that were in place for other sexually violent predators who completed the therapy program inside Atascadero.

Six other men who completed such therapy over several years were released to predetermined homes or set up with housing on the grounds of state prisons, where they lived while completing their outpatient therapy.

That will not happen with Boggs, however, because the state Department of Mental Health has been unable to find a suitable location or willing landlord and, after a year's delay in his release, a judge ordered him freed by today.

"Mr. Boggs will be picked up at Atascadero and the GPS will be put on him, as is normal procedure, and he will tell us where in Sacramento County he wants to be released to," said Cindy Radavsky, deputy director for long-term care services at DMH.

Radavsky added that officials do not know whether Boggs has housing lined up, and that because of the possibility he may end up homeless. DMH has hired a security firm to follow him 24 hours a day. If he is homeless, she noted, he may not be able to recharge his GPS tracking device regularly and so must be followed.

Boggs' attorney, Ken Rosenfeld, has argued that his client no longer poses a danger to the community and that the state had no legal right to hold him any longer.

But others were stunned that Boggs, 51, could be turned loose with little guidance and no housing after spending years in a program designed to ease his return into the community.

"Are they crazy?" asked Viktoria Fenech, the mother of one of Boggs' two 9-year-old victims from the 1980s. "They put him through a multimillion-dollar program and then they're going to let him go live under a bridge somewhere?"


Sacramento County Sheriff John McGinness learned of the plan an hour before he was sworn in as sheriff on Thursday and questioned how Boggs can be expected to succeed in completing his therapy program without a stable place to live.

"The impact on the community is obvious," McGinness said. "And it absolutely puts Mr. Boggs in a position where the likelihood of his success is minimal, at best. It's a situation where we have an obligation to ensure his safety and that of the community."

Radavsky did not dispute that Boggs' chances of success are not as great without stable housing lined up, but added that her department is bound by the judge's order two weeks ago that he be released by today.

The department made 269 separate contacts trying to find housing for Boggs, she said, "and there are just complications."

"People, once they know who it is, don't want that person living there," Radavsky said. "We've had a lot of doors shut in our face when they know who it is coming in."

Radavsky said plans call for Boggs to be picked up at Atascadero, a highly secure state hospital near San Luis Obispo, about 9 a.m. today and fit him with a GPS tracking device. Liberty Health Care, which contracts with the state to monitor such offenders, will then drive him to Sacramento and drop him off wherever he asks.

He also will be given some cash, Radavsky said, to pay for lodging and food, but she said the amount had not been determined because they did not know Boggs' plans. "That's part of what we're trying to figure out," she said. "This is unprecedented for us."

The situation is so unusual that Gov. Arnold Schwarzenegger's office was briefed about the situation Thursday, officials said.

The governor's public safety liaison, Tom Sawyer, said in a statement that the Department of Mental Health had been ordered to coordinate with local law agencies to ensure Boggs is under constant surveillance.

Once Boggs is settled somewhere, the state expects to provide him with cash and help find him a job while he completes at least another year of therapy.

At one point, officials had thought Boggs would be taken to his lawyer's office and dropped off, but Rosenfeld reacted to that notion angrily last week and insisted that he is not responsible for Boggs once he is released.

However, the department said if Boggs asked to be dropped there they would accommodate his wish.I hope they do!

After months of public outcry, convicted child molester Timothy Lee Boggs quietly checked into a downtown Sacramento residence hotel Friday afternoon, hours after being released from Atascadero State Hospital's therapy program for sexually violent predators.
Boggs, 51, paid $640 in state-supplied funds for a month's stay at the Hotel Berry near the Greyhound bus station, and checked into a studio-size room with a bathroom. But it was unclear how long he would be permitted to stay, with one source saying hotel management had asked him to leave by early next week.

The desk clerk at the hotel refused to comment.

If Boggs is forced to move, it will repeat a scenario faced by other released sexually violent predators.

Cary Verse, a Bay Area rapist, was hounded out of four homes before he found a place to live that was offered by two sympathetic attorneys. Other offenders have faced similar protests and ended up living in trailers on the grounds of state prisons.
After he entered the hotel, Boggs declined to comment to The Bee or even open his door, saying to do so would violate the conditions of his release. Boggs attorney should do the same.

The prospect of Boggs moving to a community in Sacramento County prompted at least four local governments to pass ordinances banning registered sex offenders from loitering at places where children congregate.

Suggestions that Boggs could be housed on the grounds of Folsom State Prison or the county's Rio Cosumnes Correctional Center immediately prompted the Folsom and Elk Grove city governments to pass resolutions against sex offenders loitering near schools and other public places.

Sacramento County and Galt followed suit with ordinances of their own. The county's emergency ordinance bans registered sex offenders from visiting libraries, day care centers, video arcades, skate parks, public swimming pools, county parks, youth sports facilities and bus stops in the unincorporated county.


But lawyers have said such bans are unenforceable and unconstitutional. Don't you just love lawyers.

Boggs has agreed to 13 pages of conditions for his release, including not using alcohol, not being near children and many others. Conditions for his release indicate he may have undergone chemical castration.

State Department of Mental Health officials said it is not true that Boggs is precluded from speaking to the media.

Boggs was dressed in neat white slacks, a tropical print shirt and a baseball cap Friday when he appeared at the front desk of the Berry Hotel.

He has been fitted with a satellite tracking device that he must wear at all times, and also is being watched by a private security firm that is paid by the state. Friday afternoon, two men in dark slacks and tropical print shirts stood across from the Berry, keeping an eye on the building. Neither would comment.

Boggs is the sixth man to win release from Atascadero after completing four phases of treatment inside the hospital. He now must spend at least a year continuing his therapy in Sacramento.

He was convicted in the 1980s of molesting two 9-year-old boys in separate incidents.

Boggs did not register with law enforcement officials Friday, but he has five days to do so and indicated to officials that he planned to register with police Monday.

Boggs is considered among the state's most dangerous sex offenders. However, he is one of only a handful to complete the inpatient program offered at Atascadero.

Dozens of other sexually violent predators have refused treatment and won release through court hearings, including three who now live in the Sacramento area.

Bounty hunter helps find downtown suite for Timothy Lee Boggs.

Convicted child molester Timothy Lee Boggs was ordered out of the Hotel Berry on Monday by its owner, but found temporary refuge in a suite at a downtown office building managed by Sacramento bounty hunter Leonard Padilla.

Boggs, who has been the focus of intense community protest and scrutiny, was released Friday from Atascadero State Hospital and settled into Room 610 of the Berry after paying $640 in state funds for a month's stay.

But media coverage of his presence led managers to tell him that he could not stay there, and efforts by the state Department of Mental Health to win him a reprieve failed.

"They just asked him to leave," said DMH Deputy Director Cindy Radavsky, who noted that Boggs had spent a quiet weekend in the downtown residence hotel without incident.
By early afternoon Monday, Boggs had moved into a suite at 816 H St., which houses offices for attorneys, bail bondsmen and others.

Boggs, who had a security guard hired by the state positioned outside the door to his suite, interrupted his lunch Monday to come to the door and politely decline to be interviewed.

Padilla had said he planned to allow Boggs to live there at the rate of about $750 a month until he could find a permanent home for him. One of the building's owners initially objected, but Padilla said the matter was smoothed over after he offered to rent the space himself and sublet it for Boggs to live there.

Padilla said he planned to help Boggs obtain a driver's license, a set of tools and a license to work as a handyman for area businesses. He also said he planned to take Boggs to register with police today as a sex offender.


Padilla, who previously had offered to allow Boggs to live on vacant land he co-owns in the Natomas area, said he thought the office building was ideal because it is open 24 hours a day with bail bonds companies and is not near areas where children might congregate.

"What better place than this building?" he said, after Boggs moved into the two-room suite with a large number of plastic grocery store bags he had dropped on a sofa inside. Now, Padilla said, he is offering to help Boggs "because nobody else will."
This is the best place for him.

Federal food program updated

For the first time in more than 30 years, the federal government is overhauling a massive food program that supplements the diets of 8 million poor women and children, restricting whole milk, cheese and eggs in favor of whole grains, fresh fruit and vegetables.

While the changes are not expected to take effect until late 2007, they could have a profound impact on California's children: 60 percent of all newborn infants in the state are served through the food program called WIC, an acronym for the Special Supplemental Nutrition Program for Women, Infants and Children. In high-cost Santa Clara County, nearly 32,000 women and children benefit from the monthly food vouchers of about $38 per person.

Heavy on eggs, cheese and cow's milk, the current group of WIC foods eligible for subsidy has long been criticized for contributing to obesity and overlooking current nutritional science.

The new package would cut daily juice allotments for children aged 2 to 5 nearly in half, from more than 9 ounces to less than 5 ounces, and ban it altogether for children under 2.

Women and children older than 2 would drink low-fat milk instead of whole milk, and less of it: The proposed changes recommend cutting the daily milk allotment for children and postpartum women from 3.2 cups to 2.1 cups. The monthly allotment of eggs would be cut in half,
dismaying the nation's egg producers, who issued a press statement calling the restrictions too severe.

For the first time, the government would issue special vouchers for fruit and vegetables, and ethnically diverse foods such as tortillas and tofu would be eligible for subsidy.

The proposed overhaul, which dovetails with efforts to make school lunches more healthful and less fattening, is yet another indication that the federal government is taking seriously its role in reducing obesity.

Elderly woman beaten, raped while gardening at East Oakland home

OAKLAND, Calif. - An 89-year-old woman who was working in her garden was beaten and raped by a man who fled after he was confronted by a neighbor, authorities said.

Investigators plan to release a sketch of the suspect who attacked the elderly woman, punching her several times and sexually assaulting her just before 9 a.m. Monday, according Oakland police.

The attack lasted several minutes before a neighbor realized what was happening and chased the suspect for several blocks before losing him, police said.

"It takes a sick and demented person to attack a defenseless, elderly woman who was only trying to enjoy her home," police spokesman Roland Holmgren said. "This vicious predator needs to be caught before he has the opportunity to strike again."
