I think whoever did the tattoo should have used a .22 and placed the ink on the tips. I'm sure that would have done the trick once and for all.

In the US it would vary by state, AFAIK the death penalty is only imposed in cases where the defendant is convicted of murder. Not sure about other states and exactly what the criteria is but here in Pennsylvania the crime has to have a certain set of circumstances. For example you could not be put to death if you were driving drunk and ran your car into school bus and killed everyone aboard (they would be able to seek the death penalty if they could prove you intended to do that I believe).

Walk into a convenience store and shoot the clerk and the DA can seek the death penalty.
