On October 17th, 2006, Judge Gregory Frost issued an order temporarily delaying Lundgren's execution. Lundgren is attempting to join a lawsuit with five other Ohio death row inmates challenging the state's death penalty law, claiming that because of his obesity the lethal injection would be particularly painful and amount to cruel and unusual punishment. State Attorney General Jim Petro plans on appealing to the 6th U.S. Circuit Court of Appeals in Cincinnati.[2]

Like I've said before...if they're short enough or fat enough while they commit the crime(s)...then they're also able to serve out the sentence for that crime(s)! Just more crud to stall the inevitable!
