Democrats may play hardball in Pennsylvania

Reporting from Washington -- The Northeast's dwindling cast of Senate Republicans has Democrats circling Arlen Specter's seat in Pennsylvania, convinced the party is well-positioned to make a competitive race out of the 2010 election.

Leading the pack of prospects -- at least in celebrity -- is Chris Matthews, the MSNBC "Hardball" host and a former Capitol Hill Democratic staffer. The Philadelphia native has been toying with a run for months, and this week he sat down with state Democrats to discuss the prospect of taking on the five-term GOP senator.

WASHINGTON - Hillary Clinton passed on becoming boss of the superpowerful Senate Appropriations Committee to pursue the more prestigious secretary of state job with President-elect Barack Obama, the Daily News has learned.

As chairwoman of the panel that controls the nation's purse strings, Clinton could have pumped billions in federal dollars into the Empire State.

Instead, as Obama continues to piece together his cabinet, Clinton is poised to become the third female secretary of state, following Madeleine Albright and Condoleezza Rice.

Durbin working through his grief

This should be a joyous time for Richard J. Durbin (D-Ill.), the assistant Senate majority leader.

And yet, the Saturday before election day, Durbin and his wife, Loretta, were at a Washington-area hospital as his eldest daughter, Christine, 40, succumbed to a congenital heart condition after weeks in intensive care.

He missed the jubilant celebration in Chicago's Grant Park for Barack Obama's historic victory, watching it on TV instead. And he missed his own victory celebration as staff in Chicago phoned him in Washington with the voter returns.

"It hurt because it was something that I had dreamed of, and it was just a magical night," Durbin said of the raw elation he saw in Chicago on election night. But, he said, "I was where I needed to be: with my family."

Friends say Durbin, 64, is quieter and more reflective these days. His staff says he has reminded them to stop and remember what's most important in life.

The day before Thanksgiving, Durbin was in his Senate leadership office on the third floor of the Capitol, plotting out the legislative agenda with staff and talking about the road ahead as the balance of power in Washington shifts dramatically to Democratic control.

"Getting back to work for me is therapeutic," said Durbin, who spent the holiday in the capital with family.

House Speaker Nancy Pelosi is welcoming the appointments of Hillary Clinton, Robert Gates, et al, today, praising the choices as a message of confidence to the rest of the world.

She told reporters at a morning photo-op that she had just gotten off the phone with Clinton and that she congratulated the senator.

I am shocked, simply shocked. Pelosi supports Obama. News flash - San Francisco Liberal supports Obama appointments of "centrist"cabinet. Next thing, Barabara Boxer will hold a surprise press conference to support Obama's cabinet. Oh, how marvelous! Wonderful! Genius. Where's the vomitorium? Get me outta here!

Little off topic here, but there's a great book called the Sea of Cortez.
It mostly deals with the Gulf of California and has a chapter on how it was formed by earthquakes that would have measured perhaps 20+ on a Richter scale.

Wicked stuff dude.

So, no marks at all go to Franken. Any mark for Coleman must be challenged.

We've noted the threat aimed by Franken at the heads of Minnesota authorities in the event his position on rejected absentee ballots is not adopted. Yesterday the head of Franken's legal team reiterated it for the benefit of the press including The Hill:

Franken attorney Marc Elias made the case to reporters Monday that as many as 1,000 absentee ballots were improperly disqualified and that the Senate or the courts may need to step in to resolve the issue.

"No recount can be considered accurate or complete until all the ballots cast by lawful voters are counted," Elias said of the recount that became necessary when only about 200 votes separated the two candidates on Nov. 4.

Minnesota's Board of Canvassers ruled last Wednesday that it would not revisit the improperly disqualified ballots. The bipartisan board ruled unanimously that it did not have the authority to order that the ballots be reviewed and counted.

Elias said that of the 12,000 disqualified absentee ballots in the race, "as many as 1,000" ballots were improperly excluded, and should be counted. He added that the campaign would appeal to the Board of Canvassers, courts or the U.S. Senate to ensure those ballots are counted. Last week, Elias had indicated that the campaign would not directly appeal the board's ruling.

The U.S. Constitution allows each congressional chamber to be the "Judge of the Elections, Returns and Qualifications of its own Members."

Senate Majority Leader Harry Reid (D-Nev.) called the Board of Canvassers' decision to not count the absentee ballots "a cause for great concern" last week, fueling speculation that the Senate would explore the legality of the Minnesota recount's results.

"If ultimately there is no remedy before the canvassing board or before the courts, then that is certainly an option," Elias said of the Senate's potential intervention in the election results.
Threatening the authorities who hold your case in their hands is not usually a winning strategy. Yet Franken appears to see little prospect of winning the election the old-fashioned way.

As the recount nears completion, with more than 91 percent of the votes recounted, MinnPost's David Brauer reports that "Coleman's recount margin keeps growing in the late innings."

According to MinnPost's calculation, Coleman now holds a 344-vote lead over Franken. The Star Tribune pegs Coleman's lead at 340 votes. Brauer concludes that time is running out for Franken "in this phase."

For Franken, if Elias is to be taken at his word, turning to his allies in the Senate to overturn the result arrived at in Minnesota is the final phase.
