I believe an Error 1335 is caused because your system is having a problem reading the Setup8.cab file. This could be down to a dirty CD/DVD ROM or possibly a corrupt download (depending on where you got it from).
If you have the game on CD you could try copying all the game files into a temporary folder on your harddrive and install from there, this may not wok due to copy protection on the disc though.
If you downloaded the game you may need to re-download it again.

It just came out... how on earth does it have scratches?
Just return it for a new copy, tell the store you just opened it and like an exchange, they should do that since they wont be losing anything.
