I've never heard of spyware in games coming from legit vendors / developers. Worse thing I've seen is some intrusive copy protection schemes. The only one thats caused me any problems (and MANY other people) is one called Starforce, after researching it I've decided that I will not put any games or software on my computer that use it. If you're interested here's a link to some good info regarding it.

Boycott Starforce

The games I am concerned with are those that I purchase from BestBuy. After installing there is always an icon on my desktop that goes directly to their game website. Also when I sometimes try to load the games I am ask for permission for the game to go to the internet. When I say no I can't play the game.

The games I am talking about are, " Dream Day First Home", Titanic, Mystery Case Files: Ravenhearst, Hidden Expedition Everest. If I don't allow the game to access the internet I can't play the game.
